Terms of Service
These Terms of Service are a legally binding agreement between you and 2HELP INC. (“2Help,” “we,” “us,” or “our”) governing your access to and use of the 2Help mobile application, website, communications, and related services (collectively, the “Platform”).
1. Acceptance and incorporated policies
By creating an account, selecting acceptance during registration, or otherwise using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not access or use the Platform.
The User Agreement and Community Guidelines form part of these Terms. Our Privacy Policy explains how we handle personal information. The Safety Center provides important precautions for online and in-person interactions.
2. Eligibility
You may use the Platform only if you are at least 18 years old, have legal capacity to enter into a binding agreement, and are not prohibited from using the Platform under applicable law. By using the Platform on behalf of a business or organization, you represent that you have authority to bind it to these Terms.
You may not use the Platform if we previously suspended or terminated your account for a serious violation, unless we give written permission.
3. What 2Help provides
2Help provides technology that enables users to discover one another, request help, offer help, communicate, and agree on help that may be voluntary, free, reimbursed, or paid. 2Help does not itself perform the help described by users and is not a party to any agreement between users unless we expressly state otherwise in writing.
2Help is not an emergency service, employment agency, staffing company, insurer, escrow service, bank, healthcare provider, or professional licensing authority. Do not use the Platform as a substitute for emergency services or qualified professional advice.
We do not control, direct, supervise, or guarantee a user’s identity, qualifications, licensing, insurance, conduct, availability, pricing, work, safety, legality, quality, or outcome. Any badge, verification indicator, rating, match, proximity display, or recommendation is limited to the criteria expressly described in the Platform and is not an endorsement or guarantee.
4. Accounts and account security
- Provide accurate, current, and complete information and keep it updated.
- Create and maintain only accounts you are authorized to use. Do not impersonate another person or organization.
- Protect authentication codes, linked sign-in accounts, devices, and credentials. You are responsible for activity conducted through your account unless applicable law provides otherwise.
- Notify support@2help.app promptly if you suspect unauthorized access or account misuse.
Registration email addresses and telephone numbers are used for authentication, security, support, and service communications. They are not displayed to other users as part of your public profile. You control information you separately choose to disclose in your profile, content, or messages.
5. User-to-user arrangements
When users agree on help, they enter into a separate agreement directly with each other. Before accepting, users should confirm the scope, location, timing, price or reimbursement, materials, cancellation terms, required skills or licenses, safety conditions, and any other material term. The User Agreement governs these arrangements and allocates responsibility between the requester and helper.
Each user is responsible for performing their promises, complying with applicable consumer, employment, tax, licensing, permit, insurance, health, safety, accessibility, and other laws, and independently assessing whether another user and proposed activity are suitable.
6. Free and paid help
A listing must accurately state whether help is free, involves expense reimbursement, or is paid. Users must not misrepresent compensation, add undisclosed charges, or condition free help on an unexpected payment.
If the Platform offers a supported payment flow, additional payment terms disclosed in that flow apply. If no supported payment flow is offered, users arrange payment independently and at their own risk. Unless 2Help expressly states otherwise, we do not hold funds, guarantee payment, issue refunds, determine taxes, or resolve chargebacks between users.
Users are responsible for their own taxes, reporting obligations, permits, and legally required records. Nothing in these Terms creates employment, partnership, agency, joint venture, franchise, fiduciary, or similar relationship between 2Help and any user, or between users, except where applicable law determines otherwise based on the actual relationship.
7. User content and license
“User Content” includes profiles, descriptions, photos, files, messages, requests, offers, ratings, reports, and other material submitted through the Platform. You retain ownership of your User Content and are responsible for it.
You grant 2Help a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and otherwise use User Content solely to operate, secure, improve, and promote the Platform. This license lasts for as long as reasonably necessary to provide the Platform and ends when the content is deleted from active systems, subject to technical backups, legal retention, safety, fraud-prevention, dispute, and enforcement needs.
You represent that you have all rights and permissions required for your User Content and that it does not violate law, contract, intellectual property, privacy, publicity, confidentiality, or other rights. Do not upload identity documents, financial credentials, medical records, or other sensitive information unless a specific Platform feature requests it and explains why.
8. Prohibited conduct
You must comply with the Community Guidelines. Without limitation, you may not:
- engage in fraud, deception, theft, coercion, extortion, harassment, stalking, hate, discrimination, threats, violence, sexual exploitation, trafficking, or abuse;
- request, offer, facilitate, or advertise illegal goods, services, activity, or unsafe regulated work;
- exploit minors or vulnerable persons, or submit child sexual abuse or exploitation material;
- publish another person’s private or contact information without lawful authority and consent;
- send spam, phishing, malware, unauthorized promotions, pyramid schemes, or deceptive payment requests;
- circumvent safety, moderation, access, payment, account, geographic, or technical controls;
- scrape, harvest, reverse engineer, probe, overload, disrupt, or gain unauthorized access to the Platform or its data;
- buy, sell, transfer, or share accounts or artificially manipulate matches, ratings, reports, or engagement; or
- use the Platform or its data to discriminate unlawfully or make unauthorized eligibility, credit, employment, housing, insurance, or similar decisions.
9. Safety and regulated activities
You are responsible for evaluating risk before online or in-person interaction. Follow the Safety Center, use public meeting locations when appropriate, disclose material hazards, and stop an interaction if conditions become unsafe.
Do not use 2Help to replace licensed medical, mental-health, legal, financial, emergency-response, security, transportation, childcare, eldercare, construction, electrical, gas, or other regulated services. A user offering regulated work must hold all required qualifications, licenses, permits, and insurance. A requester remains responsible for independently verifying them.
10. Moderation, reports, and enforcement
We may use automated systems and human review to detect fraud, abuse, safety risks, and violations. We may investigate, preserve evidence, remove or reduce visibility of content, restrict features or communications, cancel access to a listing, warn users, suspend or terminate accounts, and refer matters to payment providers or authorities when reasonably necessary.
Enforcement decisions consider context, severity, harm, history, and legal obligations. We are not required to monitor every interaction and cannot guarantee that all objectionable or unlawful content will be identified. To report content or conduct, use available in-app reporting tools or email support@2help.app with enough information to locate the issue.
If we restrict your content or account, you may appeal by emailing support with the account identifier, the decision at issue, and relevant context. We may decline repetitive, abusive, fraudulent, or legally prohibited appeals. We will not disclose information that would compromise another person’s privacy, security, or an investigation.
11. Intellectual property and feedback
The Platform, including its software, design, text, graphics, logos, trademarks, and other content provided by 2Help, is owned by or licensed to 2Help and protected by applicable law. Subject to these Terms, 2Help grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Platform for its intended purpose.
If you provide suggestions or feedback, you grant 2Help a perpetual, worldwide, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you without permission.
12. Third-party services
The Platform may depend on or link to services operated by third parties, including app stores, identity providers, mapping providers, cloud services, communications providers, analytics providers, and payment providers. Their terms and privacy practices apply to their services. 2Help is not responsible for third-party services outside our control.
13. Availability and changes to the Platform
We may add, modify, suspend, or discontinue features; impose reasonable limits; or perform maintenance. We do not guarantee uninterrupted, error-free, secure, or permanently available service. We will use reasonable care in operating the Platform but cannot prevent every outage, data loss, malicious act, or third-party failure.
14. Disclaimers
To the maximum extent permitted by law, the Platform is provided “as is” and “as available.” 2Help disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that users, listings, communications, services, content, locations, ratings, verifications, or outcomes are accurate, complete, legal, safe, suitable, available, or reliable.
Nothing in these Terms excludes a warranty, remedy, or right that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, 2Help and its directors, officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, data, goodwill, opportunity, or business; or harm arising from user conduct, user-to-user arrangements, off-platform activity, or third-party services, even if advised of the possibility.
To the maximum extent permitted by law, the aggregate liability of 2Help arising out of or relating to the Platform or these Terms will not exceed the greater of (a) the amount you paid directly to 2Help during the twelve months before the event giving rise to the claim or (b) USD 100.
These limitations do not apply to liability that cannot be limited or excluded under applicable law, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
16. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless 2Help and its directors, officers, employees, and affiliates from third-party claims, losses, liabilities, damages, judgments, penalties, and reasonable legal costs arising from your User Content, your breach of these Terms, your violation of law or another person’s rights, or your request, offer, performance, or receipt of help. This obligation does not apply to the extent a claim results from 2Help’s own unlawful conduct.
17. Suspension, termination, and account deletion
You may stop using the Platform at any time. You may initiate account deletion from the account settings in the app or follow the instructions in the Help Center. Deleting the app from a device does not delete the account.
We may suspend or terminate access when reasonably necessary to protect users or the Platform, comply with law, investigate suspected misconduct, address non-payment to 2Help, or enforce these Terms. Where appropriate and lawful, we will provide notice and an opportunity to appeal.
Terms that by their nature should survive termination—including ownership, user-to-user obligations, disclaimers, liability limits, indemnity, dispute provisions, and legal retention—will survive.
18. Disputes and applicable law
Before filing a formal claim against 2Help, contact support@2help.app and provide a concise description of the issue and requested resolution. We will attempt in good faith to resolve the matter.
These Terms are governed by the laws applicable to 2HELP INC. and the relevant service relationship, without overriding mandatory consumer protections or other rights that apply in your country or state of residence. Claims must be brought before a court with lawful jurisdiction. Nothing in these Terms restricts a consumer’s right to contact a regulator, law-enforcement authority, data-protection authority, consumer-protection body, or another competent authority.
19. Changes to these Terms
We may update these Terms for legal, safety, security, operational, or product reasons. We will post the revised Terms and update the effective date. When required by law or when changes materially affect your rights, we will provide additional notice and request renewed acceptance. Changes do not apply retroactively unless the law permits and we clearly state otherwise.
20. General terms
If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, asset transfer, or by operation of law, subject to applicable rights. These Terms and incorporated policies are the entire agreement between you and 2Help regarding the Platform, except for additional terms expressly presented for a specific feature.
