User Agreement
This User Agreement governs requests, offers, and arrangements for help made through 2Help. It is incorporated into the Terms of Service and applies whether help is voluntary, free, reimbursed, or paid.
1. Roles and definitions
- A Requester is a user seeking help.
- A Helper is a user offering or providing help.
- A Help Arrangement is the agreement formed directly between a Requester and Helper about a specific activity.
A user may act in either role. 2Help provides the Platform on which users can discover one another and communicate. Unless expressly stated in writing for a particular feature, 2Help is not a party to a Help Arrangement and does not request, offer, direct, supervise, or perform the underlying help.
2. Forming a Help Arrangement
A Help Arrangement is formed when a Requester and Helper clearly agree to proceed. Before agreeing, they should record in the Platform’s messages all material terms, including:
- the exact scope and expected result;
- date, time, duration, and location;
- whether the help is free, reimbursed, or paid, including amount, currency, and payment timing;
- who supplies tools, transport, materials, protective equipment, permits, or access;
- known hazards, accessibility needs, relevant experience, and required credentials;
- cancellation, rescheduling, expense, and refund expectations; and
- any lawful additional terms the users accept.
Users should not begin until important terms are clear. A material change requires the other user’s agreement.
3. Requester obligations
A Requester agrees to:
- describe the request truthfully and disclose known hazards, access limits, special conditions, and material changes;
- provide a lawful and reasonably safe environment and any agreed materials or access;
- not pressure a Helper to perform work outside the agreed scope or beyond the Helper’s qualifications;
- pay the agreed amount and approved expenses when due, unless a good-faith dispute or agreed cancellation term applies;
- respect the Helper’s right to stop when conditions are unsafe, unlawful, abusive, or materially different from what was disclosed; and
- not treat a Helper as an employee or agent unless the parties intentionally create such a relationship and comply with all resulting legal obligations.
4. Helper obligations
A Helper agrees to:
- accept only help they can perform lawfully, safely, competently, and on the agreed schedule;
- accurately describe experience, availability, price, licenses, permits, insurance, and limitations;
- use reasonable care, follow applicable safety requirements, and promptly disclose material problems or delays;
- obtain and maintain any legally required license, registration, permit, insurance, training, or authorization;
- not substitute another person or expand the work without the Requester’s consent;
- protect property, confidential information, access credentials, and personal information encountered while helping; and
- leave and report conditions involving immediate danger, abuse, exploitation, or illegal activity.
5. Independent relationship
Users decide whether to request or offer help, which opportunities to accept, their own availability, and the terms they propose. Unless applicable law determines otherwise based on the actual facts, a Helper acts independently and not as an employee, worker, contractor, agent, partner, or representative of 2Help. 2Help does not set working hours, provide tools, control the manner of performance, or guarantee a minimum amount of work or income.
This section does not determine the legal relationship between a Requester and Helper where mandatory law applies. Users are responsible for assessing and complying with any employment, worker-classification, tax, payroll, immigration, insurance, or registration obligation created by their actual arrangement.
6. Free help, reimbursement, and paid help
- Free help: no fee is due. A Requester must not add an undisclosed commercial condition after acceptance.
- Reimbursed help: users should agree in advance which reasonable expenses are reimbursable and whether receipts are required.
- Paid help: users must agree on the total price, hourly or fixed-price basis, currency, included costs, milestones if any, and payment timing.
If 2Help makes a payment feature available, the payment provider’s terms and any additional terms displayed at checkout apply. Availability of a payment button does not make 2Help the provider of the underlying help or guarantee performance. Where users arrange payment outside a supported Platform flow, 2Help does not hold the funds, process refunds, or decide chargebacks.
Users must not request payment through gift cards, cryptocurrency, wire transfer, remote-access software, or another unusual method as a condition of helping when it creates a deception, fraud, or safety risk.
7. Cancellations, non-performance, and refunds
A user who cannot proceed must notify the other user promptly through the Platform. Unless the users agreed otherwise or mandatory law applies:
- no payment is due for work not performed;
- properly documented, pre-approved, non-recoverable expenses may remain payable;
- completed conforming work remains payable even if later portions are cancelled;
- a user may stop immediately without penalty when they reasonably believe the interaction is unsafe or unlawful; and
- refunds and cancellation charges are matters between the users unless a supported payment flow expressly provides a separate process.
Nothing in this section limits statutory cancellation, refund, warranty, or consumer rights that cannot be waived.
8. Credentials, insurance, and background information
Unless a feature expressly states the exact check performed, 2Help does not verify criminal history, identity documents, professional credentials, permits, insurance, financial condition, or fitness for a particular task. Profile information and user statements are not proof of suitability.
For regulated, high-risk, in-home, transport, childcare, eldercare, health-related, construction, electrical, gas, legal, financial, or similar work, the Requester must independently confirm credentials and insurance, and the Helper must not perform work they are not legally authorized and qualified to perform.
9. Safety, property, and confidentiality
Both users must follow the Safety Center and Community Guidelines. Each user is responsible for their own conduct, property, tools, transportation, and personal safety.
Information learned through an interaction may be used only for the Help Arrangement and must not be published, sold, exploited, or retained unnecessarily. Access codes, keys, documents, images of private premises, financial information, medical information, and information about children or vulnerable persons require particular care and must be returned or securely deleted when no longer needed.
10. Taxes and legal compliance
Each user is responsible for determining and satisfying their own tax, invoicing, reporting, registration, licensing, insurance, immigration, consumer-protection, employment, and other legal obligations. 2Help does not provide tax or legal advice and does not represent that a particular form of help is lawful in every jurisdiction.
11. Disputes between users
Users should first communicate in good faith through the Platform and preserve relevant messages, photos, receipts, and agreed terms. A user may report fraud, abuse, or a safety issue to 2Help. We may review information and take action concerning Platform access, but we are not required to adjudicate private contractual disputes, award damages, collect debts, or compel performance.
Users retain any rights and remedies available under applicable law. Reports to 2Help do not extend legal deadlines or replace notice to a payment provider, insurer, police, emergency service, regulator, or court.
12. No transfer of 2Help rights
A Help Arrangement is only between the participating users. No user may make promises on behalf of 2Help, use the 2Help brand to imply sponsorship or employment, or claim that 2Help warrants, insures, endorses, or guarantees the arrangement.
13. Conflicts and changes
If this User Agreement conflicts with the Terms of Service, this User Agreement controls only for the user-to-user Help Arrangement, and the Terms of Service control for your relationship with 2Help. Users may agree to additional lawful terms between themselves, but those terms do not bind 2Help or override the Platform’s policies.
We may update this User Agreement as described in the Terms of Service. The version in effect when a Help Arrangement is formed will ordinarily govern that arrangement, except where a later change is required by law or accepted by both users.
